Spencer McGinty is an intellectual property attorney whose practice focuses on trademark prosecution, brand protection, intellectual property counseling, copyright, and enforcement. He works with businesses, entrepreneurs, creative professionals, and organizations to identify, develop, protect, and maximize the value of their intellectual property assets.
Mr. McGinty's trademark practice encompasses matters throughout the trademark lifecycle, including trademark clearance and availability analysis, U.S. Patent and Trademark Office (USPTO) prosecution, application preparation and filing, examination, Office Action responses, trademark portfolio management, maintenance, and enforcement. He counsels clients concerning the selection and protection of trademarks, service marks, logos, slogans, trade dress, and other source-identifying elements that form the foundation of a company's brand identity.
His practice also involves strategic trademark analysis, including likelihood-of-confusion considerations, the relationship between marks and goods or services, classification and identification of goods and services, distinctiveness, descriptiveness, and the development of filing and enforcement strategies designed to preserve and strengthen trademark rights. Mr. McGinty approaches trademark prosecution as part of a broader business strategy, with an emphasis on developing intellectual property portfolios that support a client's commercial objectives and long-term growth.
Mr. McGinty also advises clients on copyright protection and enforcement, including copyright registration, ownership, infringement considerations, and the protection of original creative works. His intellectual property practice allows him to evaluate trademark and copyright issues together when a client's business, brand, content, or creative assets implicate multiple forms of intellectual property protection.
In addition to prosecution, Mr. McGinty assists clients with intellectual property enforcement and dispute avoidance, including evaluating potential infringement, assessing competing intellectual property rights, developing enforcement strategies, and addressing conflicts before they unnecessarily escalate. His approach emphasizes early identification of legal and commercial risk and the development of practical, proportionate solutions.
Mr. McGinty has particular interest in intellectual property issues affecting emerging businesses, entrepreneurs, creative industries, entertainment, media, technology, and consumer-facing brands. He recognizes that intellectual property frequently represents one of a growing company's most important intangible assets and works to ensure that legal protection is aligned with the client's broader business objectives.
Prior to practicing independently, Mr. McGinty developed hands-on intellectual property experience through clinical work and private practice, including work involving trademark and copyright matters. While attending American University Washington College of Law, he participated in the Glushko-Samuelson Intellectual Property Clinic, where he obtained practical experience counseling clients concerning intellectual property issues. His clinical work included advising emerging ventures concerning trademarks, copyrights, patents, trade secrets, and related intellectual property considerations. A 2018 WCL IP Clinic program, for example, involved presentations and consultations concerning intellectual property issues for startup ventures.
Mr. McGinty also served as a Senior Staffer for the American University Intellectual Property Brief, reflecting his longstanding academic interest in intellectual property law and scholarship.
His academic work has included scholarship concerning the intersection of copyright law, litigation, substantial similarity, and the practical challenges presented by intellectual property disputes.

In this article, Mr. McGinty examines the substantial-similarity inquiry in copyright infringement litigation, including the difficulties presented when courts and juries must evaluate whether two artistic works are sufficiently similar to support infringement. The article considers the relationship between copyright doctrine, the Seventh Amendment, jury decision-making, and the challenges inherent in translating complex legal standards into determinations concerning artistic similarity.
